We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

In no case shall Beavertown, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 17 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 20 - COMPETITION GUIDELINES

The giveaway must be redeemed by Beavertown followers.
Employees of Beavertown and their immediate families are not eligible for the competition.

Winners must be 18 years and over, winners will provide photographic ID in advance of the event.

Prizes/tickets cannot be exchanged for a cash prize.

Prizes/Tickets are non-transferable.

Travel to and from events is not included in the ticket price.

Alcoholic items can only be redeemed within licensed hours by guests aged 18 and over.

Beavertown reserves the right to withdraw the competition at any time without reason.

Force Majeure: Beavertown cannot be held responsible for failure to meet its obligation when any failure is brought about due to some cause totally beyond its reasonable control.

Beavertown reserves the right to amend these terms and conditions without prior notice.

Beavertown Brewery’s Sand Cipher Competition

Promoter: BEAVERTOWN BREWERY LTD (trading as Beavertown Brewery), a company incorporated and registered in England and Wales with registered company number 07704796 and registered office address at Unit 17 & 18 Lockwood Industrial Estate, Mill Mead Road, London, N17 9PQ ("Beavertown").
Entry period: The Promotion opens for entry at 07:01 am (UK time) on 24/10/2023 and closes at 11:59 pm (UK time) on 31/10/2023 ("Entry Period").

Eligibility:

  • To participate in the Promotion, entrants must be a legal resident within the UK and be at least 18 years old at the time of entry. Residents of Northern Ireland and the Republic of Ireland are excluded.
  • For the ("Beavertown Brewery’s Sand Cipher Competition") the entrant must be over the age of 18.
  • Entrants must be UK residents (excluding Northern Ireland)
  • Entrants can only enter once
  • Beavertown Brewery reserves the right at any time to require proof of eligibility in such form as Beavertown Brewery reasonably considers necessary.

Not eligible: The following persons are not eligible to enter the Promotion: (i) any employee or other individual engaged by Beavertown Brewery or any of its associated companies or other alcohol brands; (ii) anyone under 18 (iii) anyone else professionally involved with the operation or administration of the Promotion.
How to enter: To enter the Promotion, entrants must fill out an entry form ("Entry Form") here during the Entry Period.

Prizes:

There are (10) prizes to be won in this Promotion ("Prize"). The Prizes consist of:
1 x £100 voucher to be spent on the Beavertown webshop

Prize conditions:

The following conditions apply to the Prize:

  • The Prize is non-transferable, non-refundable, non-exchangeable. However, if Beavertown Brewery considers it appropriate, or if it becomes necessary for reasons beyond Beavertown Brewery’s control, the Prize may be varied or swapped for a suitable alternative at Beavertown Brewery’s discretion.
  • The Prize is provided by BEAVERTOWN BREWERY LTD (the "Prize Provider"). The winner should ensure they are aware of any applicable dates and other conditions associated with the Prizes.
  • Winners can win one Prize only.

Winner selection:

The first 10 entrants to enter the correct answer on the ENTRY FORM will win The Prize. Any correct answers that follow after these 10 winning entries will not be eligible.

Winner notification:

The 10 winners will be notified using any of the contact details provided in their Entry Form before midnight 31/10/23. Beavertown Brewery will make reasonable efforts to contact the winners, but it is each winner's responsibility to monitor their voicemail and email account, including any junk mail folder, for receipt of the notification.

Claiming the Prize:

Each winner must accept the Prize by confirming their eligibility and acceptance within one (7) days of the date of that initial winner's notification. Failure to accept the Prize by the deadline may result in the Prize being forfeited and the selection of an alternative winner. Alternative winners will be selected and notified as set out above and must claim the prize within 7 days.

Prize delivery:

  • The "Beavertown Brewery’s Sand Cipher Competition" prize will be delivered no later than midnight 10/11/2023.
  • The Prize (£100 voucher code) will be emailed to the winner’s email address provided by the entrant on the ENTRY FORM.
  • The Prize can be used for one order only, with some products excluded.

Publicity:

By entering this Promotion, each entrant agrees that in the event of a win, the entrant will take part in reasonable publicity connected with the Promotion if requested and that Beavertown Brewery is entitled (but not obliged) to use the winner's name and image in connection with such publicity. Each entrant agrees that Beavertown Brewery and/or its representative, Here Be Dragons Ltd, may share, publish or promote any image, video, text or other content submitted or uploaded to any website in connection with this Promotion on its corporate website, blogs or its Facebook, Instagram or Twitter account. Winners may be required to sign an image release form for this purpose, including for data protection purposes.

Liability:

Beavertown Brewery will not be liable for: (i) any loss that is not caused by Beavertown Brewery (or any person acting on Beavertown Brewery’s behalf); (ii) any loss caused by any event or circumstance beyond Beavertown Brewery’s reasonable control; (iii) any loss of profits or revenue, loss of anticipated savings or loss of goodwill; or (iv) any unavailability of the Beavertown Brewery website. However, nothing in these Rules limits or excludes any person's liability for death or personal injury caused by negligence, for fraud or for any matter for which it would be illegal to limit or exclude liability. In particular, consumers have legal rights in relation to products that are faulty or not as described and services which are not performed with reasonable care and skill and these legal rights are in addition to and are not affected in any way by anything contained in these Rules. No Endorsement:

This Promotion is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram and Twitter ("Social Networks") or any other third party save as expressly stated otherwise. Access to Social Networks is at all times subject to the relevant Social Network's rules, terms and policies. To the maximum extent permitted by applicable law, the Social Networks and any other social networking platform on which the Promotion is communicated shall have no liability to any person in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, damages and other liabilities.

Beavertown Brewery reserves the right to vary, suspend or cancel the Promotion and/or these Rules if it considers it necessary or appropriate to do so, including if there is any actual or anticipated breach of applicable law; fraud, abuse, and/or an error (either human or machine) affects or could affect the proper operation of this promotion or the awarding of prizes or offers, or if variation, suspension or cancellation is necessary due to an event outside Beavertown Brewry’s reasonable control. In the event of cancellation, the Prize may be awarded to a winner drawn from entries received prior to cancellation.

Disqualification:

Without limiting the options available to Beavertown Brewery, Beavertown Brewery reserves the right at any time to disqualify entries or entrants (including the winner) that Beavertown Brewery regards as being in breach of these Rules, any applicable laws, any terms and conditions referred to in these Rules or the spirit of the Promotion.

Disclosure of Winner's Details:

By entering this Promotion, each entrant acknowledges that in the event of a win their surname, county of residence may be disclosed to persons enquiring where permitted by law. Any entrant may object to their information being made available in this way, or may request that the amount of information made available be reduced, by contacting Beavertown Brewery using the contact details at the end of these Rules. In these circumstances, the entrant acknowledges that Beavertown Brewery may nevertheless disclose the relevant information, and the entrant's entry, to the UK's Advertising Standards Authority if required to do so. This may happen where Beavertown Brewery is required to demonstrate that it has awarded the prizes advertised. To request disclosure of winners' details, enquiries must submit a request within three months of the end of the Promotion. Details will only be disclosed (if permitted by law) after the Prize has been validly claimed.

Accessing these Rules:

Any website on which these Rules are posted is only intended to be accessed from England and where permitted by law. Beavertown Brewery makes no representation that materials relating to this Promotion are appropriate or available for use at other locations. Access to them from territories where their contents are illegal is strictly prohibited.

Severance and Waiver:

If any part of these Rules is or becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the rest of these Rules will not be affected. Beavertown Brewery’s failure to enforce any term of these Rules will not constitute a waiver of that provision.

Disputes:

Subject to Rule 22, if there is a dispute about the Promotion or these Rules, Beavertown Brewery’s decisions are final. If there is a dispute between these Rules and any other document referred to in these Rules, these Rules take precedence to the extent necessary to resolve the conflict.

Law and jurisdiction:

The Promotion and these Rules are governed by English law, and any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Personal data:

Entrants acknowledge that any personal data of entrants processed in connection with this Promotion will be processed in accordance with the Beavertown Brewery’s Privacy Notice at https://beavertownbrewery.co.uk/pages/privacy-policy. In particular:

  • Beavertown Brewery is the controller in respect of entrants' personal data obtained in connection with the Promotion.
  • Beavertown Brewery will process, and permit the processing of, entrants' personal data for the purposes described in these Rules and Beavertown Brewery's Privacy Notice, which purposes include the administration of the Promotion.
  • It is necessary for Beavertown Brewery to use entrants' personal data to perform its obligations to entrants in relation to the administration of the Promotion or it is in Beavertown Brewery’s legitimate interest to use entrants' personal data in the ways described in these Rules in order to ensure the proper administration of the Promotion.
  • Beavertown Brewery may share entrants' personal data with Here Be Dragons in order to assist with the administration of the Promotion.
  • Beavertown Brewery will retain entrants' personal data for as long as it is required for the purposes described in these Rules and Beavertown Brewery’s Privacy Notice.
  • Entrants have certain rights in relation to their personal data, including: (i) to obtain copies of it; (ii) to have it corrected or deleted; (iii) to limit the way in which it is used; (iv) to object to its use; (v) to transfer it; (vi) not to be subject to decisions based on automated processing (including profiling); and (vii) to complain to the regulator, the UK Information Commissioner's Office. From time to time, the Promoter may share entrants’ personal data with their agents/representatives to assist with administering the promotion, contacting entrants and prize fulfilment (as necessary). By participating in the promotion, you agree to the use of your personal data as described here.

Who can enter:

  1. Only open to GB residents aged 18 or over, excluding employees of any company in the Heineken group, their immediate families, and any person whom, in the Promoter’s reasonable opinion, should be excluded due to their involvement or connection with this promotion.
  2. Internet access, access to a device capable of scanning a QR code and a valid email address are required.
  3. Entries must be made personally. Entries made through agents/third parties, bulk entries or automated entries are invalid. No entries submitted via any other means will be accepted. The promoter cannot guarantee uninterrupted or secure access to the web entry route. Any mechanical reproduction or automated entries is prohibited, and any use of such automated devices will cause disqualification.
  4. How to enter: The promotion opens on 09.10.23 at 00.01 hours and closes on 20.11.23 at 23:59 hours. Any entries received outside the promotional period will not be accepted.
  5. To enter purchase a promotional pack of Beavertown Neck Oil or Beavertown Gamma Ray (4x440ml can pack) in store or online (subject to availability), scan the QR code on the outside of the pack using your handheld device and follow the on-screen instructions. Enter your full name, email address and the code on the inside of the pack where instructed to do so. Entries which do not follow these processes will be void. Standard network rates apply. Service in store is at the discretion of checkout staff.
  6. After you have filled in your details and entered the promotion, you can play the game and reveal the mystery location. Your entry will still be valid if you do not play the game.
  7. Maximum of 1 entry per promotional pack purchased. Entrants must have a valid email address. All valid entrants will have the chance to win either the Tier 1 prize or one Tier 2 prize from their entry.
  8. Failure to comply with the T&Cs will make the entry automatically void.
  9. The prizes: There are 2 tiers of prizes available.
    • Tier 1: There is one 7 night trip for 2 adults to a mystery overseas country with 2 centre locations worth around £10,600*:
      • Prize includes accommodation, economy flights (including 1 cabin bag and 1 hold bag per person), private transfers from mystery location airport to the accommodation and back for return flights, six activities, a local underground pass for two adults valid for 6 days and £1000 spending money per pair.
      • Activities are (i) Lunch at a Robot Restaurant to the value of £100. (ii) two tickets to the Future Museum (iii) Two tickets to a VR/AR theme park (iv) Two tickets to a 4D cinema (v) A snorkelling experience. Travellers are recommended to have at least a competent level of swimming for this activity (vi) Bike hire for two people through volcanic countryside. All activities are subject to availability at the time of booking and are to be organised between the winner and the Promoter’s nominated prize fulfilment company.
      • Prize is valid for redemption from 1st March 2024 until 30th September 2024 (subject to the terms below, and specifically clause 10) excluding the Easter weekend and all other bank holiday weekends in the UK within the dates set out in this paragraph. Extensions to the validity of the prize will not be allowed unless first authorised by the Promoter’s nominated prize fulfilment agent, MIH Handling (“MIH Handling”) and will be subject to winner covering all such costs.
      • All members of the party must be aged 18 or over.
      • Accommodation for the first 5 nights is a 3 star hotel, double or twin room including breakfast each day. Amenities include free wifi, 24-hour front desk, lift, terrace, daily housekeeping, heating, air conditioning.
      • Accommodation for the final two nights is a 3 star hotel, double or twin room, including breakfast each day. Amenities include free wifi, pool, fitness centre with gym / workout room, bar / lounge, beach, bicycle rental, laundry service.
      • Ferry and bus transfers for two people provided to and from second accommodation location.
      • Return flights from a UK airport including 1x hold bag approximately 23kg and 1 x cabin bag approximately 15kg per person. Please note, weights may vary slightly between different airlines. Winners are permitted to choose their preferred UK airport but should be aware that the chosen airport may not offer direct flights.

    • Tier 2: Beavertown Halloween Graphic Novel & Beavertown Merchandise.
      • Prizes include: Beavertown Halloween graphic novels x 150, Beavertown branded t-shirts x 100 & hats x 100
      • In respect of Tier 2 prizes, winners will receive 1 graphic novel or one piece of merchandise only, prizes will be allocated at random, winners will not have a choice on which merchandise they receive or if they receive merch or the graphic novel.
  10. In respect of the Tier 1 Prize:
    • The Tier 1 Prize is a trip to a mystery location which will be revealed to the winner when they are notified they are a winner. Entrants are able to follow clues on beavertownbrewery.co.uk/pages/destination-unknown to reveal the location of the Tier 1 prize at an earlier date at their discretion. By entering the Promotion, entrants are deemed to accept that the destination is determined by the Promoter in its discretion and not within the control of an entrant, and may not be suited to the entrant’s individual preferences.
    • Requests to change the location of the Tier 1 prize are not permitted. If, after being notified that it is a winner in accordance with Clause 14 below, an entrant no longer wishes to participate in the promotion as a result of the location of the Tier 1 Prize being revealed, it shall notify the Promoter (or its agent) accordingly within the timescales set out in Clause 17 below, and a new winner will be selected in accordance with that Clause.
    • The Promoter cannot guarantee that the trip will be free from disruptions, failings or cancellations. Some activities and/or experiences may be seasonal and/or weather dependant. Some activities/experiences may have age, height, weight and/or health restrictions. The Promoter shall have no responsibility or liability in the event that a member of the party is unable to participate in the activity or trip for any reason.
    • The travel arrangements, accommodation and activities are subject to availability at the time of booking the trip and travel dates will be agreed with and arranged by MIH Handling at the time of booking. Accommodation bookings cannot be changed once reserved. The winner must notify MIH Handling a minimum of eight weeks in advance of their preferred dates for taking the trip.
    • The winner will be allocated a £1000 travel allowance All other costs and expenses in taking up the prize not set out in the stated prize description will be at the winner’s expense, these include but are not limited to meals, drinks and gratuities, excursion or other travel expenses (in excess of the £1000 travel allowance provided).
    • All travel arrangements offered are at the discretion of the promoter (or the promotional agent) and will be arranged by the promoter. Any requests relating to travel service providers cannot be guaranteed.
    • A visa may be required for the trip depending on the nationality of the winner and/or guest. The winner and guest are responsible for checking if this is needed, applying for this and covering the cost of the application. The promoter is not liable for any failure by the winner or guest to obtain visa in accordance with the entry requirements of the mystery location. It is the winner and guest’s responsibility to ensure they meet any other necessary requirements to travel (including holding a valid passport or other visa documentation).
    • It is the winner and guest’s responsibility to comply with any Covid-19 and other vaccination or health requirements as applicable. MIH Handling cannot be held responsible for the winner and guest not having the correct travel documentation, test results or following any COVID-19 regulations or other health and vaccination requirements or regulations.
    • Any permissible amendments made by the prize winner after the booking is confirmed may be subject to administration charges levied by the specific supplier.
  11. There is no cash or other alternative to these prizes in whole or in part. Prizes are not transferable and non-refundable. The Promoter reserves the right to reclaim the prize if it is transferred.
  12. In the event that any prize is unavailable or in the event of circumstances beyond the Promoter’s control, the Promoter reserves the right to substitute a similar prize, in its sole discretion, of equal or higher value.
  13. The winner of the Tier 1 prize and the winners of each Tier 2 prize will be selected at random from all valid entries on 27.11.23. The prize draw will be conducted by an independent adjudicator. The judge’s decision is final.
  14. The Tier 1 winner will be notified via email by MIH Handling, (beavertown@mihhandling.co.uk) on behalf of the Promoter within 7 days of the draw date with details of how to claim their prize. MIH will then communicate with the winner to arrange the booking of the Tier 1 prize. Emails will be sent to the email address provided on entry and the Promoter cannot take any responsibility for email addresses entered incorrectly. Winners are encouraged to monitor their email accounts, including junk and spam folders, during this time.
  15. Tier 2 winners will be notified via email by MIH Handling, (beavertown@mihhandling.co.uk) on behalf of the Promoter within 7 days of the draw date with details of what prize has been won and instructions on how to claim their prize. Winners will be required to specify their preferred t-shirt size (where a t-shirt has been won) (sizes available are EU small, medium, large or extra large) and provide their home address to arrange for delivery of the prize. Winning emails will be sent to the email address provided on entry and the Promoter cannot take any responsibility for email addresses entered incorrectly. Winners are encouraged to monitor their email accounts, including junk and spam folders, during this time.
  16. Tier 2 prizes will be dispatched to winners within 28 days of the winner’s acknowledgment of the notification (in accordance with clause 17 below) and confirmation of the entrant’s home address for delivery. Prizes will be dispatched by registered post and a signature may be required. The Promoter assumes no responsibility for mistakes in delivery addresses and prizes returned undelivered shall be void. The promotor will not replace any lost, damaged or stolen prize items once they have been dispatched or are in the winners’ possession.
  17. All winners are required to reply to the email notifying them of their win to indicate their acceptance (or in the case of the Tier 1 prize, rejection) of the applicable prize within 7 days. Should the Promoter not receive email acknowledgement from any winner within 7 days after winner confirmation (for any reason), the Promoter reserves the right to void the prize and to select another winner by way of a random draw by an independent adjudicator at the end of the promotion. All unclaimed or rejected prizes will be included in this mop up draw and will be allocated on a random basis to the individual(s) selected at random from all valid remaining entries. Re-selected winners will then be emailed within 7 days and have 7 days to acknowledge receipt (and confirm their home address for delivery in respect of Tier 2 prizes). This process will be repeated until a winner is found for each unclaimed prize.

Additional terms and conditions:

If fulfilment or any element of this promotion will be delayed or affected due to an epidemic or pandemic and resulting Government restrictions, all entrants affected will be contacted by the Promoter and kept updated of any unavoidable changes to the promotional dates, revised fulfilment dates or prizes.

It is the responsibility of the entrant to promptly provide correct, up-to-date details when entering the promotion and on acceptance or booking of their prize. The Promoter cannot be held responsible for winners failing or delaying to supply accurate information which affects prize acceptance or delivery of their prize.

The Promoter accepts no responsibility for lost, incomplete, illegible, misdirected, invalid or delayed entries, all such entries will be void. Proof of sending is not proof of receipt and promoter does not accept any responsibility for the non-receipt or the late receipt of entries due to network failure or for any associated costs to entrants. No entries submitted via any other means will be accepted. Entrants who make an entry on someone else’s behalf will be disqualified. The Promoter cannot guarantee uninterrupted or secure access to the entry route.

The Promoter reserves the right to verify all entries and winners and may refuse to award a Prize or withdraw prize entitlement or refuse further participation in the promotion where there are reasonable grounds to believe there has been a breach of these Terms and Conditions, the spirit of the promotion or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The promoter reserves the right to request a valid ID from any entrant or winner to verify their identity and/or age before making the prize award. The Promoter will be the final arbiter in any decisions, and these will be binding.

Winners’ details (first names and county only) will be available for consultation once known and until 20.01.24 by sending a Stamped Addressed Envelope to BEAVERTOWN HALLOWEEN ON-PACK WINNER, Mesh Marketing, 16 Laystall St, London, EC1R 4PF. By entering, the winner consents to such information being disclosed upon request, if you wish to object (or limit) your information being published please contact the Promotional agent at beavertown@mihhandling.co.uk. Without prejudice, the Promoter will provide this information to the Advertising Standards Authority on reasonable request.

If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation but will always endeavour to minimise the effect to participants in order to avoid undue disappointment.

The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion, the fulfilment of the prizes and/ or the use of the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

The decision of the Promoter in all matters is final and binding and no correspondence will be entered into.

The Promoter is not responsible for any third-party acts or omissions.

The Promoter reserves the right to cancel or amend this promotion at any time due to circumstances beyond its control.

The Promotion and these Terms (including any non-contractual disputes or claims arising out of them) are governed by English law. Any disputes must be referred to the English courts.

Beavertown Creatives Untapped Terms: April 21st 2023

These are the terms and conditions ("Rules") that apply to Beavertown Brewery’s Creatives Untapped Competition ("Promotion"). By entering the Promotion, each entrant agrees to these Rules and confirms they have read and understood the Beavertown Brewery Privacy Notice at https://beavertownbrewery.co.uk/pages/privacy-policy.

  1. Promoter: BEAVERTOWN BREWERY LTD (trading as Beavertown Brewery), a company incorporated and registered in England and Wales with registered company number 07704796 and registered office address at Unit 17 & 18 Lockwood Industrial Estate, Mill Mead Road, London, N17 9PQ ("Beavertown").
  2. Entry period: The Promotion opens for entry at 07:01 am (UK time) on 21/04/2023 and closes at 11:59 pm (UK time) on 19/05/2023 ("Entry Period").
  3. Eligibility:
    • To participate in the Promotion, entrants must be a legal resident within England, Scotland or Wales and be at least 18 years old at the time of entry. Residents of Northern Ireland and the Republic of Ireland are excluded.
    • For the ("Creatives Untapped Competition") the entrant must be over the age of 18.
    • Entrants must be UK residents
    • Entrants must be currently working in the UK’s hospitality industry and have been in their current position for two months or more.
    • A limit of one (1) entry per person applies to this Promotion, however, the entrant can upload multiple pieces of artwork within that application as part of a PDF that doesn’t exceed 10MB.
  4. Not eligible: The following persons are not eligible to enter the Promotion: (i) any employee or other individual engaged by Beavertown Brewery or any of its associated companies or other alcohol brands; (ii) Creatives who do not work as part of the UK’s hospitality industry (iii) anyone else professionally involved with the operation or administration of the Promotion.
  5. How to enter: To enter the Promotion, entrants must fill out an entry form ("Entry Form") on https://beavertownbrewery.co.uk/blogs/news/creatives-untapped-2023 during the Entry Period.
  6. Prizes: There are (10) prizes to be won in this Promotion ("Prize"). The Prizes consist of:
    • 1 x £1,000 prize money per winner (10 altogether)
    • Promotion of artwork via Beavertown’s marketing channels
    • A feature in an article on editorial platform, It’s Nice That
    • Artwork feature in Creatives Untapped exhibition during the Summer of 2023
  7. Prize conditions: The following conditions apply to the Prize:
    • The Prize is non-transferable, non-refundable, non-exchangeable. However, if Beavertown Brewery considers it appropriate, or if it becomes necessary for reasons beyond Beavertown Brewery’s control, the Prize may be varied or swapped for a suitable alternative at Beavertown Brewery’s discretion.
    • The Prize is provided by BEAVERTOWN BREWERY LTD (the "Prize Provider"). The winner should ensure they are aware of any applicable dates and other conditions associated with the Prizes.
  8. Winner selection: 10 winners will be chosen from a shortlist and each receive £1000 prize money bank transfer (not cash), alongside marketing support and promotion. Entrants will be rated against the following criteria:
    • Originality (or Extraordinary): How unique and innovative is the style of the work?
    • Technical skills: Does the submission/entrant demonstrate technical skills in their particular medium or format?
    • Emotional impact: Does the work evoke a reaction?
    • Presentation: Is the submission well-crafted and professionally presented?
    • Eligibility: That the entrant fits the criteria e.g. is working in hospitality and a creative.
  9. Winner notification: The winner will be notified using any of the contact details provided in their Entry Form before midnight 12/06/23. Beavertown Brewery will make reasonable efforts to contact the winners, but it is each winner's responsibility to monitor their voicemail and email account, including any junk mail folder, for receipt of the notification.
  10. Claiming the Prize: Each winner must accept the Prize by confirming their eligibility and acceptance within two (2) days of the date of that initial winner's notification, and providing their bank account details for the prize money transfer. Failure to accept the Prize by the deadline may result in the Prize being forfeited and the selection of an alternative winner. Alternative winners will be selected and notified as set out above and must claim the Prize within two (2) days.
  11. Prize delivery:
    • The "Creatives Untapped" prize will be delivered no later than midnight 31st July 2023.
    • The winner must have a functioning bank account and must provide their bank details within two (2) days of the date of that initial winner's notification. Beavertown Brewery will then make the bank transfer within one (2) months of receiving their details.
    • The winner must also send physical versions (or be happy for Beavertown to create them on their behalf) of their winning submissions to Beavertown Brewery before 19/06/23 to be used at the summer showcase.
  12. Publicity: By entering this Promotion, each entrant agrees that in the event of a win, the entrant will take part in reasonable publicity connected with the Promotion if requested and that Beavertown Brewery is entitled (but not obliged) to use the winner's name and image in connection with such publicity. Each entrant agrees that Beavertown Brewery and/or its representative, Here Be Dragons Ltd, may share, publish or promote any image, video, text or other content submitted or uploaded to any website in connection with this Promotion on its corporate website, blogs or its Facebook, Instagram or Twitter account. Winners may be required to sign an image release form for this purpose, including for data protection purposes.
  13. Liability: Beavertown Brewery will not be liable for: (i) any loss that is not caused by Beavertown Brewery (or any person acting on Beavertown Brewery’s behalf); (ii) any loss caused by any event or circumstance beyond Beavertown Brewery’s reasonable control; (iii) any loss of profits or revenue, loss of anticipated savings or loss of goodwill; or (iv) any unavailability of the Beavertown Brewery website. However, nothing in these Rules limits or excludes any person's liability for death or personal injury caused by negligence, for fraud or for any matter for which it would be illegal to limit or exclude liability. In particular, consumers have legal rights in relation to products that are faulty or not as described and services which are not performed with reasonable care and skill and these legal rights are in addition to and are not affected in any way by anything contained in these Rules.   14. No Endorsement: This Promotion is in no way sponsored, endorsed, administered by or associated with Facebook, Instagram and Twitter ("Social Networks") or any other third party save as expressly stated otherwise. Access to Social Networks is at all times subject to the relevant Social Network's rules, terms and policies. To the maximum extent permitted by applicable law, the Social Networks and any other social networking platform on which the Promotion is communicated shall have no liability to any person in connection with or arising out of the Promotion howsoever caused, including for any costs, expenses, damages and other liabilities.
  15. Interference with the Promotion: Any attempt to deliberately damage or undermine the content or legitimate operation of this Promotion is prohibited and may be a violation of criminal and/or civil laws and in these circumstances, Beavertown Brewery reserves all its rights and remedies.
  16. Cancellation and Variation: Beavertown Brewery reserves the right to vary, suspend or cancel the Promotion and/or these Rules if it considers it necessary or appropriate to do so, including if there is any actual or anticipated breach of applicable law; fraud, abuse, and/or an error (either human or machine) affects or could affect the proper operation of this promotion or the awarding of prizes or offers, or if variation, suspension or cancellation is necessary due to an event outside Beavertown Brewry’s reasonable control. In the event of cancellation, the Prize may be awarded to a winner drawn from entries received prior to cancellation.
  17. Disqualification: Without limiting the options available to Beavertown Brewery, Beavertown Brewery reserves the right at any time to disqualify entries or entrants (including the winner) that Beavertown Brewery regards as being in breach of these Rules, any applicable laws, any terms and conditions referred to in these Rules or the spirit of the Promotion.
  18. Content of entries: Entries must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, including copyright infringement, or legal or moral rights of any third party, living or deceased (e.g., names, logos, symbols, slogans, photographs that belong to others, photographs of other people, quotes from other people, or parodies of other people); must not disparage Sponsor or any other third party (e.g., any person, product, location, retailer, company or brand); must not in any way contain any names, logos, symbols, slogans, parodies or trademarks of any brand other than those of Sponsor; must not include personally-identifiable information; must not contain material that is inappropriate, indecent, lewd, pornographic, obscene, hateful, tortious, defamatory, slanderous or libelous, or features gratuitous violence dangerous stunts, real weapons of any kind, or drug use; must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; must not contain material that is unlawful, in violation of, or contrary to any laws or regulations; must have been legally created (i.e., does not violate any laws or regulations in the making of the photo); and must comply with all requirements of Instagram.
  19. Disclosure of Winner's Details: By entering this Promotion, each entrant acknowledges that in the event of a win their surname, county of residence may be disclosed to persons enquiring where permitted by law. Any entrant may object to their information being made available in this way, or may request that the amount of information made available be reduced, by contacting Beavertown Brewery using the contact details at the end of these Rules. In these circumstances, the entrant acknowledges that Beavertown Brewery may nevertheless disclose the relevant information, and the entrant's entry, to the UK's Advertising Standards Authority if required to do so. This may happen where Beavertown Brewery is required to demonstrate that it has awarded the prizes advertised. To request disclosure of winners' details, enquiries must submit a request within three months of the end of the Promotion. Details will only be disclosed (if permitted by law) after the Prize has been validly claimed.
  20. Accessing these Rules: Any website on which these Rules are posted is only intended to be accessed from England and where permitted by law. Beavertown Brewery makes no representation that materials relating to this Promotion are appropriate or available for use at other locations. Access to them from territories where their contents are illegal is strictly prohibited.
  21. Severance and Waiver: If any part of these Rules is or becomes invalid, illegal or unenforceable, the validity, legality and enforceability of the rest of these Rules will not be affected. Beavertown Brewery’s failure to enforce any term of these Rules will not constitute a waiver of that provision.
  22. Disputes: Subject to Rule 22, if there is a dispute about the Promotion or these Rules, Beavertown Brewery’s decisions are final. If there is a dispute between these Rules and any other document referred to in these Rules, these Rules take precedence to the extent necessary to resolve the conflict.
  23. Law and jurisdiction: The Promotion and these Rules are governed by English law, and any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  24. Personal data: Entrants acknowledge that any personal data of entrants processed in connection with this Promotion will be processed in accordance with the Beavertown Brewery’s Privacy Notice at https://beavertownbrewery.co.uk/pages/privacy-policy. In particular:
    • Beavertown Brewery is the controller in respect of entrants' personal data obtained in connection with the Promotion.Beavertown Brewery will process, and permit the processing of, entrants' personal data for the purposes described in these Rules and Beavertown Brewery's Privacy Notice, which purposes include the administration of the Promotion.
    • It is necessary for Beavertown Brewery to use entrants' personal data to perform its obligations to entrants in relation to the administration of the Promotion or it is in Beavertown Brewery’s legitimate interest to use entrants' personal data in the ways described in these Rules in order to ensure the proper administration of the Promotion.
    • Beavertown Brewery may share entrants' personal data with Here Be Dragons in order to assist with the administration of the Promotion.
    • Beavertown Brewery will retain entrants' personal data for as long as it is required for the purposes described in these Rules and Beavertown Brewery’s Privacy Notice.

If your card is authorised, payment will provisionally be taken from your account immediately by your card issuer. This also includes Beavertown Brewery Gift Vouchers. All of our products are priced in GBP and then translated using up-to-date exchange rates.

Why has my payment method been declined?

Please check the card details you have entered including expiry date, billing address and security code. If all of these are correct your card issuer may have declined your payment. As card issuer’s do not share this information with us it is advisable that you contact your card issuer directly.

You may be prompted by your bank to add a 3D secure verification password at the end of your payment.

3D secure is an additional security measure for online credit and debit card transactions (Visa and Mastercard). It is controlled by Visa and Mastercard.

If you are having problems remembering your password, please contact your credit card company in order to reset your password or simply request a password reset at the point of verification.

All refunds will be processed via the original payment method.

Paying by Paypal

Go through the secure checkout as normal and select ‘PayPal'. You will be taken to the PayPal site to log into your account and set up the payment. VAT is payable on all online shop orders shipped to a uk address regardless of the country where the order is placed. Vat will be deducted at the checkout on all orders being shipped outside the uk. These shipments may be subject to unexpected local taxes,customs charges & fees. Customers are responsible for these costs and should ensure they are happy to pay them prior to ordering. Some non beer items manufactured outside the uk & eu may also be subject customs duty charges, please email webshop@beavertownbrewery.co.uk if you wish to clarify country of origin on any goods.

If you later decide to reject the goods, when a customs charge is applicable, we reserve the right to deduct shipping and any other costs incurred prior to processing any refund.

DELIVERY

Before you place your order, you are given various delivery options to choose from with estimated delivery times. Once the order has been placed, these are then unable to change.

SECTION 22 - PROMOTIONS

Beavertown Satellite - Free 4 Pack TESCO

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the terms and conditions and by entering this promotion all participants will be deemed to have accepted and be bound by the terms and conditions.  Please retain a copy for your information.

The personal data provided by participants will only be used by the Promoter for the purpose of conducting the promotion and at all times in accordance with the Data Protection Act 2018 and the Promoter’s Privacy Policy (available at https://beavertownbrewery.co.uk/pages/privacy-policy).  The Promoter has appointed Hashting UK Limited (company no. 12242883, with registered office address Wisteria Grange Barn, Pikes End, Pinner, Middlesex, United Kingdom, HA5 2EX) (“Hashting”) to facilitate the promotion including issuing of cashback in accordance with these terms and conditions. All processing of participant personal data by Hashting will be in accordance with the Promoter’s Privacy Policy hyperlinked above. 

1. Only open to residents in the UK and Channel Islands and Isle of Man aged 18 or over for products purchased in England only. 

2. Participants can claim cashback up to a maximum of £7.00 upon proof of purchase of any 4x330ml pack of Beavertown Satellite from a participating Tesco store in England (subject to availability).

3. Service is at the discretion of the checkout staff. Participants must retain their itemised receipt as proof of in-store purchase. Online purchases on participating store platforms in England are included in the cashback campaign and participants must retain a screenshot of their online itemised receipt. No more than one cashback request to be made per person. The cashback campaign is limited to 6,000 valid cashback claims. The cashback service will be facilitated by the Promoter’s third-party service provider, Hashting. 

4. For instructions on how to claim cashback using your receipt, participants can follow the link provided in the Promoter’s social media posts published on the Beavertown Meta platforms and in Beavertown CRM mailers. 

5. Participants will be taken to Hashting’s landing page, upon which participants will be asked whether they wish for the instructions on how to claim cashback to be sent to them via WhatsApp or SMS. Participants will then receive a link via their chosen communication method. Mobile phone access is required and standard network rates apply. Using the link contained in the automated SMS/WhatsApp message (which will be accessible until seven (7) calendar days after the end of the Campaign Period (as defined in clause 8 below)), participants will be asked to provide: 

  • their first and last name; 
  • their email address; 
  • the product they purchased; 
  • the amount they paid for the product; 
  • a photo/upload of their receipt as evidence of the amount paid (the price shown on the receipt shall be paid in cashback up to the maximum amount of £7.00 as set out above);  
  • answers to marketing insight questions; and 
  • confirmation as to whether they wish to receive their refund via PayPal or by BACS. If the former, participants will be asked to provide their PayPal email address; if the latter, participants will be asked to provide their sort code and account number. 
6. Upon submitting the above information, participants will be directed to a webpage notifying them that their request has been received and is under review by Hashting. Hashting verifies all requests to ensure their compliance with these terms and conditions. Having reviewed the request, Hashting will contact participants using the email address provided to confirm that: 
  • their cashback claim has been accepted and approved, along with the specific amount due to be refunded; or 
  • their cashback claim has been rejected, and the reason(s) why; or 
  • more information is required by Hashting to review the claim properly (for example, the photo of the receipt is unclear and therefore a new one must be uploaded). 

7. Hashting will process and issue any approved refunds to successful participants within thirty (30) calendar days of the participant submitting their request for cashback via PayPal or by BACS as referred to in clause 5 above. For the avoidance of doubt, refunds cannot be exchanged for other goods or services and can only be received by the original purchaser of the product. 

8. The cashback campaign opens at 00:01 on 01 March 2024 and closes either at 23:59 on 05 April 2024 or the time and date on which maximum cashback redemptions have been received for either product, whichever is earlier (the “Promotion Period”). Participants will be immediately notified if the Campaign Period has ended when they click the promotional link. 

Product Review Promotion 

9. Upon submitting a cashback claim, in accordance with these terms and conditions, participants will receive an automated SMS/WhatsApp message with instructions on how to enter into a prize draw to win £200 in cash by leaving an honest review of Beavertown Satellite. There is one (1) prize to be won. This message will contain a link to the product review page on the website for the store from which the product was originally purchased.  To clarify, participants will only be able to leave one review and therefore will only be entered into the prize draw once. The product review promotion will be facilitated by the Promoter’s third-party service provider, Hashting. 

10. After leaving a review, participants must then reply to the automated message with the name/nickname that they left the review under no later than seven (7) calendar days after the end of the Promotion Period. Participants will then receive a message to confirm that they have been entered into the prize draw. 

11. The prize draw will take place fourteen (14) calendar days after the Promotion Period has ended and the winner will be selected at random from all valid entries by Hashting via a random number generator. The winner will be notified by Hashting by email within five (5) working days of the draw.  The prize is non-transferable. 

12. The winner’s first name and county will be made available by Hashting on request. By entering, the winner consents to such information being disclosed. 

13. The Promoter has the absolute discretion to refuse to include a participant in the prize draw where their review: 

  • promotes excessive, irresponsible, or underage consumption of alcohol; 
  • uses offensive, obscene, pornographic, abusive, false, misrepresenting, defamatory or malicious content; 
  • includes or refers to other brands; 
  • includes content to which someone else owns the copyright, without the requisite authorisations; 
  • includes advertisements or solicitations of business; or 
  • breaches these terms and conditions. 

General 

14. Requests for cashback and reviews must be made personally. Requests/reviews made through agents/third parties, bulk requests or automated requests are invalid. No multiple requests/reviews from a single IP address will be valid.  Amended, defaced or photocopied requests/reviews and accompanying photo evidence will be invalid. The Promoter accepts no responsibility for lost, damaged, incomplete, illegible or delayed requests/reviews or accompanying evidence, and such requests/reviews will be void. Proof of sending is not proof of receipt and Promoter does not accept any responsibility for the non-receipt or the late receipt of WhatsApp/SMS messages or the request/reviews itself due to network failure or for any associated costs to participants.  No requests/reviews submitted via any other means will be accepted. The Promoter cannot guarantee uninterrupted or secure access to the web entry route. Any mechanical reproduction or automated requests are prohibited, and any use of such automated devices will cause disqualification.  

15. The Promoter reserves the right to: 

  • verify all cashback requests, reviews and the winner themselves; 
  • refuse cashback or award of the prize; 
  • withdraw the prize entitlement and/or refuse further participation; or 
  • disqualify the participant, 

16. where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or applied for cashback using fraudulent means.  The Promoter will be the final arbiter in any decisions and these will be binding and no correspondence will be entered into. The decision of the Promoter in all matters is final and binding and no correspondence will be entered into. 

17. The Promoter is not responsible for any third party acts or omissions. 

18. The Promoter reserves the right to cancel or amend this promotion due to events or circumstances arising beyond its control.  

19. The cashback campaign is in no way sponsored, endorsed or administered by, or associated with, Meta. Meta is not responsible to participants in respect of any aspect of this promotion.

21. These rules and any dispute or difference arising out of or in connection with them shall be governed by, and construed in accordance with, English law.  The Promoter and each participant irrevocably agrees to submit to the exclusive jurisdiction of the Courts of England and Wales over any claim or matter arising under or in connection with these rules or the legal relationships established by this agreement.  

 

 

SECTION 23 - EVENTS

DEFINITIONS

“Event Terms and Conditions”: These event terms and conditions, which apply to every legal relationship between a Visitor and an Organiser with regard to the visiting of an Event with a Ticket, the purchase of a Ticket and the related purchase of a product and/or service (of Third Parties) on the Website

THE EVENT TERMS AND CONDITIONS

The Event Terms and Conditions are applicable if the visitor visits an Event with a Ticket, purchases a Ticket and/or a related product or service (of Third Parties) on the Website. The event terms and conditions are declared applicable prior to the Visitor’s purchase of a Ticket and/or product or service. By purchasing a Ticket, by visiting an Event with a Ticket and/or by buying a product and/or service (of Third Parties) on the Website, the Visitor accepts these General Terms and Conditions. The General Terms and Conditions also apply if the Ticket, regardless of the manner, was acquired through a third party.

The Organiser is Beavertown Brewery [Unit 17, Lockwood Industrial Park, Mill Mead Rd, Tottenham Hale, London. N17 9QP]

During the purchase of a product and/or service (of Third Parties) and/or a Ticket on the Website, the Visitor has the possibility to access the General Terms and Conditions before he proceeds to conclude the agreement electronically.

These Event Terms and Conditions solely apply to private persons and specifically exclude parties acting in their capacity as professional contracting parties in relation to the Organiser. The legal relationship between the Organiser and a professional contracting party is subject to alternative terms and conditions.

AMENDMENT OR ADDITION TO THE EVENT TERMS AND CONDITIONS

The Organiser is at all times entitled to amend or complement the Event Terms and Conditions. The amended version will in that case be published on the Beavertown company Website. As of the date of publication, the amended event terms and conditions will be applicable. If an amendment or addition significantly affects the rights or obligations of the Visitor, the Organiser will either notify the Visitor of the amended event terms and conditions by way of email or by clearly bringing it to the Visitors attention during the visit of the Event and/or the Website.

If the Visitor visits the Event and/or purchases a Ticket or products and/or services (of Third Parties) on the Website after amendment of or addition to the Event Terms and Conditions, the Visitor thereby irrevocably accepts the amended or complemented General Terms and Conditions. If the Visitor does not wish to accept these amended or complemented General Terms and Conditions, the Visitor must immediately cease the use and visitation of the Website and/or Event(s) or the purchase of the Tickets or products and/or services (provided by Third Parties) on the Website.

VISITING THE EVENT

Access to the Event is only obtained by showing a valid and undamaged Ticket. People wishing to enter the Event may be requested and will then be obliged to show proof of identity due to checks on the age limit (if applicable). In the event, after entry, the Visitor leaves the Event or its location, the Ticket will automatically lose its validity.

People younger than 18 will simply be refused entry to the Event, unless explicitly otherwise determined by the Organiser. The Organiser will not be obliged to refund the amount of the Ticket.

Tickets are and remain the property of the Organiser. The Ticket gives the holder the right to attend the Event. Access is given only to the first holder of the Ticket provided at the entrance of the Event. The Organiser may presuppose that the holder of this Ticket is also the person who has a right to it. The Organiser is not obliged to perform any further verification of Tickets. The Visitor must take responsibility for ensuring that he or she is and remains the (sole) holder of the Ticket issued by the Organiser or by an advance sales address that it has engaged.
As of the time that the Ticket has been provided to the Visitor, the Visitor bears the risk of any loss, theft, damage or misuse of the Ticket. The Ticket is only supplied once and gives access to only one person.

The Organiser reserves the right to set a maximum on the number of Tickets to be ordered by a Visitor, in that case the Visitor is obliged to comply with such maximum number.

Solely purchases at the authorized (pre)sale addresses or with the Organiser guarantee the validity of the Tickets. The burden of proof in this regard rests on the Visitor. The Ticket may consist of a barcode provided to the Visitor via electronic communication (e-mail). In the event the Visitor has chosen to receive the Ticket in this manner, the Visitor must ensure that the Ticket can be provided by electronic communication and that it can be provided in a safe manner. Organiser cannot guarantee the confidentiality of the issued Ticket or guarantee the receipt of the admission ticket. Scanning the Ticket from a mobile device of the Visitor is done at the sole risk of the Visitor. Organiser cannot be held liable in the event the Ticket cannot be scanned and the Visitor is not entitled to a refund of the amount of the Ticket and/or compensation in this case.

PROHIBITING AGAINST RESALE

Tickets for the Event may not in any way be resold by the Visitor in the context of commercial purposes.

The Organiser may appoint an authorized resale platform (e.g. an additional official sales channel) for Tickets for the Event, which could be an online secondary ticket marketplace. Reselling Tickets on any sales channels other than the ones appointed by the Organiser is strictly forbidden. Access to the Event may be refused for a Visitor holding a Ticket purchased from an unauthorized source. The Organiser cannot be held liable nor can any damages be claimed resulting from the sale or purchase of a Ticket (including the validity of a Ticket) for the Event via any sales channel.

The Visitor is not allowed to make any type of advertising or any other kind of publicity relating to the event or any part of it.

SEARCHES & CAMERA SURVEILLANCE

The Organiser is entitled to search or arrange for Visitors to the Event to be searched before entering and/or during the Event. If the Visitor refuses to be searched, he may be refused entry to the Event or may be immediately removed from the Event, without any right to a refund of the amount of the Ticket.
Cameras may be available that make recordings of the area/the venue where the Event takes place, for the purpose of surveillance and safety.

REFUSAL OF ENTRY INCLUDING PROHIBITED ITEMS

At the risk of confiscation, a Visitor may not bring, either for himself or another person – or have in his possession – at the Event venue, glassware, (alcoholic) beverages, drugs (among others drugs that are listed on list I and II of the Opium Act), nitrous oxide (cartridges), cans, fireworks, weapons and/or dangerous objects (including – but not limited to – spray cans or CS gas) or use such items prior to or during an Event. The venue of the Event may apply other and/or additional policies which apply to this article and the Event, which in that case also applies to the Event. Confiscated items will not be returned.
Any Visitor who breaches this may be refused entry or further access without any right to a refund of the amount of the Ticket, or may be removed from the Event and/or handed over to the police. The Organiser has the right to destroy the confiscated items.

The Organiser reserves the right to refuse specific people entry or further access to the Event or to remove them from the Event and/or hand the Visitor over to the police if it deems this necessary for maintaining public order and safety during the Event and/or there is a violation of an article from these Event Terms and Conditions. This also applies if a Visitor wears or carries clothing, texts or signs which, in the opinion of the Organiser, may be offensive, discriminating, insulting to or cause aggression or unrest among other Visitors or does not comply with dress code as specified by the Organiser, as well as to undressing during the Event (including but not limited, for instance, to exposing the upper part of the body). Even if an Ticket is likely to be counterfeit, the Organiser is entitled to refuse to admit the holder of this Ticket to the event without the Visitor or this holder being able to claim any compensation for any loss that this may cause him or restitution of the amount of the Ticket.

FILM AND IMAGES

Recording the Event in a professional and/or commercial form, including photographing, filming (including drones), making sound and/or image recordings, as well as reprinting and/or copying from the programme booklet, posters and other printed materials is not permitted without the express, prior and written consent of the Organiser.

OWN RISK & LIABILITY

The Visitor enters the Event venue and attends the Event at his own risk. Organiser cannot be held liable for any damage which the Visitor has suffered in this regard.
The Visitor is expressly aware that loud music will be played during the Event. The Organiser advises Visitors to occasionally give their hearing a rest during the Event by going to an area where no music is being played and to wear ear protection at all times. Organiser accepts no liability for hearing loss, damage to sight, blindness and/or other bodily injury and/or damage of goods, such as but not limited to clothing, whether or not brought by other visitors to the Event.

Organiser is solely liable for damage to the Visitor resulting from a shortcoming attributable to the Organiser. The total liability of Organiser is always limited to the compensation for the reasonable, demonstrable and direct out-of-pocket damage and costs of the Visitor, provided that this liability is always limited to the amount covered by the legal liability insurance of the Organiser.
Liability of Organiser for indirect damage, including consequential loss, intangible damage, loss of profits, lost savings and / or damage due to company stagnation is excluded.

The Visitor is obliged to report any damages to the Organiser within 48 hours of the Event.

The Visitor shall indemnify the Organiser for all claims of third parties in respect of damages for which the Visitor is liable against such third parties under the law. The Visitor shall compensate Organiser for any damage, including all legal costs incurred by Organiser, resulting from any claim from those third parties.

FURTHER RULES

The Visitor to the Event is obliged to comply with the regulations, internal rules, any amendments thereof and the instructions of the Organiser, the operators of the Event venue, the security staff and other authorised parties. Security cameras may be present at the Event venue.

If the Visitor fails to comply with an order or breaches a rule prohibiting certain behaviour, he or she will be immediately removed by the security staff.
Specific rules may apply to the site or venue of any Event and will be announced or published on site. If possible, these rules will also be published in advance on the Website.

CANCELLING OR MOVING THE EVENT/MOVING THE EVENT IN CASE OF FORCE MAJEURE

In case of force majeure in the broadest sense, which in this regard also includes the illness and/or withdrawal of the artist(s), strikes, pandemics, terrorist threat, decision to cancel by the competent authority, fire, bad weather conditions, etc., the Organiser will be entitled to move the Event to another date or location or to cancel the Event.

The Organiser will not be responsible for damage arising from moving or cancelling the Event, as referred to above. If the Event is moved or cancelled, as referred to above, the Organiser will publicise this fact as far as possible in the manner that it deems appropriate, including among others through mentioning the applicable terms for a refund. in case of full cancellation, the Organiser will refund the ticket price as mentioned on the Ticket, but not the booking fees and any incurred travel and accommodation costs, to the Visitor at his request. This applies in the event the Ticket was bought by the Visitor at the authorized (pre)sale addresses of the Organiser, and is not applicable in the event the Visitor bought the Ticket at any other sales platform, including but not limited to online secondary ticket marketplaces.

In the event the Event is rescheduled by the Organiser due to unforeseen circumstances, the Ticket will remain valid for the new date that the Event is moved to. If the Visitor is not able to attend the Event on the new date, he is entitled to submit his Ticket at the (pre) sale address against refund of the amount of the Ticket (excluding service fees) that the Visitor has paid via the authorized (pre)sale addresses. This refund will only take place if the Visitor is able to deliver a valid and undamaged Ticket on time to the (pre)sale address, as specified on the Website.

IMAGE & SOUND RECORDINGS

The performers and/or Organiser is for commercial purposes authorised to make or arrange for image and/or sound recordings to be made of the Event and the Visitors to the Event and to reproduce and/or publicise or arrange for the publication of these recordings in any form and in any manner. By obtaining an Ticket to the Event and/or entering the Event venue, the Visitor unconditionally consents to the aforementioned recordings being made and to the processing, publication and use thereof, in the broadest sense, without the Organiser or any of its affiliated companies being liable to pay any compensation to him at any time.

TICKET PURCHASING

If the Visitor purchases a Ticket for an Event of the Organiser, the payment and delivery for this Ticket will be handled for the Organiser by a third party ‘Eventbrite’. This third party may apply its own terms and conditions which are applicable to the payment and delivery of the Ticket. The Organiser is not responsible for the content of these terms and conditions.

The Organiser that manages the Website is in no way liable for errors, malfunctions or defects in or upon payment by this third party(s) to the Website and/or to the third party website.

The Visitor cannot return the purchased Ticket. By purchasing a Ticket, the Visitor enters into an agreement with the Organiser to perform a service for leisure activities – the Event.

LIABILITY

The Organiser will not be responsible under any circumstances towards the Visitor or third parties for errors, limited information or details on any Website except in case of intent or wilful recklessness towards the Visitor. The Organiser or Third Parties involved in the performance of any service or agreement will not be liable under any circumstances for damage, costs, lost profits, losses, consequential damage, loss of privacy or loss of data for any direct or indirect use or functioning of the Website.

The Organiser will not be liable under any circumstances for the Visitor following any link or hyperlink to a Third Party website or for the Visitor entering into any agreement with this Third Party. The Organiser will likewise not be liable under any circumstances for the messages posted by others on any forum or via any social medium that cause material or immaterial damage to the Visitor in any way.
Organiser cannot be held liable for theft and/or loss of properties of the Visitor at the Event venue.

PERSONAL INFORMATION

The Organiser uses personal information of its clients and Visitors of the Website in accordance with the General Data Protection Regulation and the Implementing Law General Data Protection Regulation.

INTELLECTUAL PROPERTY RIGHTS

Everything that is made available on the Website, social media and during the Event or which belongs thereto, including music files, artists’ names, label names, streamings, downloads, software, designs, drawings, logos and trademarks forms part of the intellectual property of the Organiser or any licensor thereof by law or on the basis of an agreement.

SECTION 24 - PRODUCTS

BEAVERTOWN GIFT CARDS

You can only purchase a giftcard if you’re 18 or over and cannot ‘gift’ it to any recipient under the age of 18. Giftcards can only be used on products and merchandise bought via the Beavertown brewery website (exclusions include some of the following: pubs, grocery channels, Beavertown Corner Pin and Beavertown Taproom). Giftcards cannot be sold on or exchanged for cash. Giftcards have a 2 year expiry date which activates once received by the recipient, if a giftcard expires without being used the money attributed to the card will be lost.

When purchasing a giftcard you must make sure all contact and delivery details are correct, failure to do this may mean the voucher gets emailed to the wrong person, or lost. If this happens we won’t be able to locate it or replace it. You must only share the giftcard code or QR code with the intended recipient. All uses of giftcards will be honoured in good faith. Once purchased no refunds can be given.
Beavertown Brewery reserves the right to cancel any giftcards without warning where fraud or misuse is suspected.

BEAVERTOWN SUBSCRIPTION

By signing up for a Beavertown Skullscription Subscription box, you understand that your beers will be delivered monthly. You can only edit, pause or cancel your subscription after a two month minimum sign up.

When you sign up for the monthly agreement you are committed to a minimum of 2 months. During this time your case of beers cannot be changed, cancelled, or paused. After that if you wish to cancel, pause (although that will make us sad), or change your beer selection then you can.

Your Beavertown Skullscription Subscription box is a flexible service, you can cancel or pause anytime (after the min 2 month sign up period), but please check the information on each type of subscription for details.

Your payment card will be charged either monthly or in a block dependant on which Skullscription option you have selected: If you pay monthly, your payment card will be charged on the same day you made the original purchase each month, ahead of your order being sent out. You’ll receive a reminder email each month before your payment is taken. If you pay in blocks of either 3, 6 or 9 months your payment card will be charged upfront for the full Skullscription period. After this point, if you wish to cancel, it may not be possible.

Please note, our Skullscription pricing may be subject to change (this includes the cost of delivery), however if this does happen, we’ll make sure to notify you before these changes are made. It may be more difficult to contact you if you don’t have an account with us so we would recommend creating an account to ensure you’re kept up to date on all changes to your Skullscription.

You acknowledge that by signing up to a Skullscription subscription box, you will be charged monthly for both delivery of your order and the order itself.

By signing up to Skullscription you are authorising us and our third-party payment providers to take payment and/or to charge your payment card for the relevant amounts and at the relevant times. The despatch of your box is subject to us being able to charge your payment card. It is your responsibility to update your payment card details and address as necessary and check that the details in your account are correct.

When signing up to Skullscription, the only credit/debit card information sorted will be the expiration date, card type and the last 4 digits of the card.
Each Skullscription box will be fulfilled for the original date (or close to the original date) you signed up. If you wish to make a change to the delivery date, this can be updated in your Skullscription details via your account, up to 2 days before your payment is due to be taken. We will try to meet the date requested.

We’ll be sad to see you go, but if you do wish to cancel or pause your Skullscription, you’ll need to action it at least 2 days before your next payment is due. After this point we cannot guarantee your request will be actioned, and you will be charged as usual. Sorry, we won’t be able to offer a refund after this point.
We’ll do our best to deliver your order the same time each month, but please check your specific subscription for details. If you’re not in, our delivery partners may look for a safe space to leave your box, and if that’s not possible, we’ll let you know and will arrange a time to redeliver.

If you’re not happy with your Skullscription box or something has gone wrong, your box can be returned by following our returns policy here and will be refunded once received.

Please don’t use and abuse us, if we suspect any of our services being used incorrectly or shared inappropriately, we reserve the right to cancel your subscription without warning.
